1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Gamgee Labs Private Limited ("Company," "we," "us," or "our") governing your access to and use of the gamgee.ai website and the Hypabase platform, including any related services, features, content, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Services.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features of the Services, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

4. Description of Services

Gamgee provides context infrastructure for AI agents, including:

• Hypabase: An open-source hypergraph engine for knowledge representation
• Hypabase Memory: A memory layer for AI agents with structured fact extraction and retrieval

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with or without notice.

5. Acceptable Use

You agree not to use the Services to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the Services
• Engage in any activity that could damage, disable, or impair our infrastructure
• Use the Services for any illegal, harmful, or fraudulent purposes
• Scrape, harvest, or collect data from the Services without authorization

6. Intellectual Property

The Services and their original content, features, and functionality are owned by Gamgee Labs Private Limited and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Open Source Components: Hypabase is released under the MIT License. Your use of open-source components is governed by their respective licenses.

You retain ownership of any data you submit to the Services. By using the Services, you grant us a limited license to process your data solely to provide the Services to you.

7. Data and Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

You are responsible for ensuring that your use of the Services complies with all applicable data protection laws and regulations.

8. Third-Party Services

The Services may integrate with or contain links to third-party services, including AI providers such as Anthropic, OpenAI, and Amazon Bedrock. Your use of such third-party services is subject to their respective terms and conditions.

We are not responsible for the content, privacy practices, or availability of any third-party services.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMGEE LABS PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

Our total liability for any claims arising out of or relating to these Terms or the Services shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gamgee Labs Private Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Services or your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
